H1B visa appeal help?

Hi.. i am working for a company in the US (not a consultant), they applied for my visa (H1B advanced degree) and it got rejected,My visa rejection reciept has a stamp dated 11th of april and the reason was visa cap being filled. The company lawyer says it is not true and they must have mistakenly had me on the regular quota and they have appealed this decision. Are they right and would my appeal go through. can anyone help me get info on this issue?
